Is Blackjack Open in ND?

Blackjack is not legal in North Dakota. In fact, it is illegal to play any form of gambling in the state, with the exception of horse and dog racing.

This includes blackjack, poker, roulette, and other similar games.

The prohibition on gambling in North Dakota is based on state law N.D. Cent. Code § 27-01-06.

This statute makes it illegal to gamble, with the exception of authorized racing activities. The code section defines gambling as “the playing of any game or sport with cards, dice, or any other device or article for gain or loss.”.

Based on this definition, blackjack is not a game that can be lawfully played in North Dakota. Gambling activity generally refers to games that can be profit or loss based on the results of the game.

Blackjack does not fit this definition because players do not directly win or lose money as a result of the game.
