Is Poker Legal in Idaho?

Poker is legal in Idaho, as long as it is played in a private home and with chips that are not made of real money. There are no state-sponsored poker tournaments, and no association or league that governs poker.

The Idaho Legislature has considered legalizing online poker, but no bill has passed. .

The legality of poker in Idaho is currently being litigated in federal court. In February 2012, the US Department of Justice filed a civil complaint in US District Court for the District of Nevada alleging that PokerStars and Full Tilt Poker were operating an illegal online gaming business.

The DOJ sought an injunction to stop the companies from conducting business in the US, and asked for a declaration that online poker was illegal under federal law.

In November 2012, a federal judge in Nevada granted the DOJ’s request for an injunction, ruling that online poker was illegal under US law. The DOJ appealed the decision, and on May 7, 2014, the Ninth Circuit Court of Appeals upheld the injunction.

The DOJ then filed a motion to dissolve the injunction, which was denied on December 14, 2014.

As of February 2015, PokerStars and Full Tilt Poker are still operating as illegal online gaming businesses in the US. However, they no longer offer US players the opportunity to participate in their games.
